DYISHENG Brand Protection Notice on Trademark Misuse and Counterfeit Pump Sales in China

Concerning the Trademark Misuse by Dongguan City DYISHENG Pneumatic Tools Co., Ltd. in China

Since its establishment in 1986, DYI SHENG INDUSTRY CO., LTD. has evolved from manufacturing automatic mixers to focusing on the research, design, and production of Air-Operated Double Diaphragm (AODD) Pumps. In 2003, the company registered its first version of the DYISHENG trademark, and since 2010, has adopted the current version of the DYISHENG trademark. Both versions are legally registered in the Republic of China (Taiwan) and are fully protected under exclusive trademark rights.

Recently, our company discovered that “Dongguan City DYISHENG Pneumatic Tools Co., Ltd.” in Mainland China has unlawfully misappropriated our first version of the DYISHENG trademark, applying for registration under Class 7 (Machinery and Equipment) and using it for industrial product sales. In response, we make the following solemn statement:

1. No Affiliation

DYI SHENG INDUSTRY CO., LTD. (Taiwan) has no equity, cooperation, agency, or authorization relationship with Dongguan City DYISHENG Pneumatic Tools Co., Ltd.

2. No Business Transactions

Our company has never engaged in any form of commercial dealings with the aforementioned company, nor have we authorized them to sell or represent any of our products.

3. Trademark Counterfeiting

Products marketed by the company under the name “Taiwan DYISHENG Pumps” are in fact counterfeit products misusing our first version of the DYISHENG trademark. They are not manufactured within DYI SHENG’s production and quality management system. We urge all buyers and users to exercise caution to avoid mistaken purchases.

4. Trademark Protection Case History

As early as 2015, our company filed an opposition against the registration of the “DYI SHENG & Device” trademark in China by Mr. Lin O-Wei. After review, the Trademark Office of the State Administration for Industry and Commerce of China ruled that the application constituted bad-faith registration of a prior-used and influential trademark, and ultimately denied registration. This case demonstrates DYISHENG’s consistent commitment to protecting its trademark rights and brand reputation, with zero tolerance for any misuse or counterfeiting.

   5. Brand Rights Protection Actions

Our company has begun collecting relevant evidence and will pursue legal action against the unauthorized use and misappropriation of our trademarks. We will also claim compensation for any illicit gains made under our company’s name in order to protect our brand assets and the legitimate rights of our global customers.

At the same time, we remind all buyers and business partners: Only pumps and spare parts purchased through the official DYI SHENG INDUSTRY website or authorized sales channels—under the name “TDS-DYISHENG”—are guaranteed as genuine products, with full after-sales service and technical support. Any products marketed as “Taiwan DYISHENG” but sourced from unknown channels are highly likely to be counterfeits, with unverified quality that may pose safety and maintenance risks.
